Below is Labor Code 1703. We are required to post it.
It outlines the cancellation policy.
Labor Code 1703;
1703. (a) Every contract and agreement between an artist and a talent service shall be in writing, in at least 10-point type, and contain all of the following provisions:
(1) The name, address, telephone number, fax number (if any), e-mail address (if any), and Internet Web site address (if any), of the talent service, the artist to whom services are to be provided, and the representative executing the contract on behalf of the talent service.
(2) A description of the services to be performed, a statement when those services are to be provided, and the duration of the contract.
(3) Evidence of compliance with applicable bonding requirements, including the name of the bonding company and the bond number, if any, and a statement that a bond in the amount of fifty thousand dollars ($50,000) must be posted with the Labor Commissioner.
(4) The amount of any fees to be charged to or collected from, or on behalf of, the artist
(5) If you cancel your contract within 10 days of purchase, all fees you have paid towards your membership must be refunded to you within 10 business days after delivery of the cancellation notice to the talent service “receiving the services, and the date or dates when those fees are required to be paid”.
You will pay in advance via credit card. TVI Actors Studio is a talent training service. This is not a talent agency contract. Only a talent agent licensed pursuant to section 1700.5 of the labor code may engage in the occupation of procuring, offering, promising, or attempting to procure employment or engagements for an artist. TVI Actors Studio is prohibited by law from offering or attempting to obtain auditions or employment for you. It may only provide you with training. For more information, consult chapter 4.5 (commencing with section 1701) of part 6 of division 2 of the labor code. A dispute arising out of the performance of the contract by the talent service that is not resolved to the satisfaction of the artist should be referred to a local consumer affairs department or local law enforcement, as appropriate.
YOUR RIGHT TO CANCEL: By paying with a credit card, and entering your address, name, and phone number, you have entered into a contract with TVI Actors Studio to provide you with the option for training at our facilities for one year. Membership is a monthly fee, you must provide a credit card to participate.
You may cancel this contract and obtain a full refund for the price of your membership, without any penalty or obligation, if notice of cancellation is given, in writing via email, within 10 business days from the date on your receipt, or the date on which you commence utilizing the services under the contract, whichever is longer.
For purposes of this section, business days are Monday through Friday. To cancel this contract, email a signed and dated copy of the following cancellation notice or any other written notice of cancellation to TVI Actors Studio firstname.lastname@example.org or fax number 19175917143, not later than midnight of 10 days after said receipt, or 10 days after the date of the beginning of utilization of service. As this contract is executed in part or in whole through the Internet, you may cancel the contract by sending the notification to: email@example.com. You may NOT obtain a refund after the 10-day cancellation period described above (in paragraph 5 of section 1703 of Labor Code 4.5) has expired.
CANCELLATION NOTICE: You need to send us this contract, and the following “cancellation notice” if you wish to cancel your membership (please either cut and paste this or print this entire contract for your records). If you do not follow these written procedures for cancellation set forth in the contract, we can not refund your membership payment.
I hereby cancel this contract.
If you cancel your membership, all fees you have paid for your membership must be refunded minus the deposit fee to you within 10 business days after delivery of the cancellation notice to the talent service.
Our biggest rule is you must be on time. You do have a grace period but must arrive by the end of the Q&A (or 15 minutes into the workshop, whichever comes first). If you don’t, and there is an actor on standby, we will give your spot away to that actor, and issue you a credit for a future workshop.
Occasionally, there are issues with an instructor arriving on time (traffic, casting sessions running long, wildfires, etc.). If a casting director or teacher is less than an hour late, we do not issue credits for people who can’t stay. The exception is if someone has let us know ahead of time that they need to use a “go early”, in which case, we will issue a credit. Most workshops run about 3 hours or less- but some do run over when an instructor is taking a lot of time with the actors, so please plan accordingly. We do NOT issue credits because you decide to leave a workshop that you think is running long. We respect your decision, but we can not be issuing credits for teachers wanting to spend extra time with our students!
Each actor is allowed 3 “go earlies” a year (so people don’t take advantage, and so they are really reserved for emergency or really important situations)- but you must be there 15 minutes before when you have a “go early” or you forfeit the early spot and will just be on the list where you would normally be. You must email firstname.lastname@example.org 24 hours before a workshop in order to use an “early” (you can’t just tell the reader when you show up that you have to leave), and you must receive a confirmation email back that we have received your request in order to confirm that you can indeed use it. Please note that you can not use an early pass for a “format departure” workshop that is in a class setting (everyone in the room- these are rare, but they do happen, and this is specifically listed in the workshop description).
Each of our instructors are scheduled in advance. If there are changes to their schedules or their resumes (where they work, who they work for), we cannot be held responsible- this is truly part of the business, and the shows are there to let you know their experience as you choose who you want to learn from. We will try to get you as much information as quickly as we can if there are any changes. If instructors have to cancel unexpectedly we will inform you ASAP and reschedule. We apologize for any inconvenience this may cause.
TVI Actors Studio reserves the right to terminate membership at any time. By submitting information, the actor agrees to release TVI Actors Studio of any liability. If you choose to terminate your membership, you may not join again in the future (in certain extreme cases, if you wanted to “freeze” a membership, we may be able to work something out, so please email us if you find yourself in an extreme situation).
For correspondence, we prefer that you call or email TVI. (818) 784-6500 or email@example.com
Disclaimer: Workshops/Classes are NOT job interviews. The presence of an industry professional is in no way a promise of employment. TVI Actors Studio does NOT attempt to procure employment for actors/artists-we are strictly for educational purposes.
